Agreement to Terms
These Terms of Service constitute a legally binding agreement between you and Emotive Engineering ("Company", "we", "us", or "our"), the maker of PiggyBucket, concerning your access to and use of piggybucket.com and any related mobile application or service (collectively, the "Site"). By accessing the Site, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use immediately.
We reserve the right to modify these Terms at any time. We will indicate changes by updating the "Last updated" date at the top of this page. Your continued use of the Site after any change constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
Nature of the Service
PiggyBucket is a virtual allowance and financial education tool for families. It operates as a virtual ledger only. No real money is stored, held, transmitted, or managed by PiggyBucket or Emotive Engineering. Balances displayed in the app represent virtual accounting entries agreed upon between a parent and their children. PiggyBucket is not a bank, payment processor, money transmitter, or financial institution of any kind.
Nothing on the Site constitutes financial, investment, tax, or legal advice. All allowance amounts, interest rates, and savings goals are set by you as the parent or guardian and are entirely your responsibility.
Intellectual Property Rights
Unless otherwise indicated, the Site and all its content — including source code, designs, text, graphics, and logos — are the proprietary property of Emotive Engineering and are protected by applicable intellectual property laws. You are granted a limited, personal, non-commercial license to access and use the Site. No part of the Site may be copied, reproduced, distributed, or commercially exploited without our express prior written permission.
User Representations
By using the Site, you represent and warrant that:
- You are at least 18 years of age and have the legal capacity to agree to these Terms.
- All information you provide is accurate and current.
- You will not access the Site through automated or non-human means.
- You will not use the Site for any illegal or unauthorized purpose.
- Your use of the Site will not violate any applicable law or regulation.
If you provide inaccurate or incomplete information, we reserve the right to suspend or terminate your account and refuse future access.
Accounts and Parental Responsibility
PiggyBucket accounts are for parents and guardians only. By creating an account, you accept full responsibility for all activity that occurs under your account, including the management of child profiles. You are responsible for maintaining the confidentiality of your login credentials and for any use of your account.
Children do not create accounts on PiggyBucket. Any data you enter about a child — including their name, virtual balances, and savings goals — is entered by you and remains under your control.
Prohibited Activities
You may not use the Site to:
- Violate any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the Site or its infrastructure.
- Transmit any malware, spam, or other harmful code.
- Scrape, crawl, or otherwise extract data from the Site by automated means.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Use the Site for any commercial purpose not expressly authorized by us.
Feedback and Submissions
If you send us feedback, suggestions, or ideas about the Site, you agree that we may use and share such submissions for any purpose without compensation or attribution to you. We do not assert ownership over your account data — only over general product feedback you voluntarily provide.
Site Management
We reserve the right to monitor the Site for violations of these Terms, take appropriate action against violators (including reporting to law enforcement), and remove or restrict access to any content or account at our sole discretion. We may do so without notice or liability.
Term and Termination
These Terms remain in effect while you use the Site. We reserve the right to deny access, suspend, or terminate your account at any time and for any reason without notice or liability, including for breach of these Terms. If your account is terminated, you may not re-register without our express permission.
Modifications and Interruptions
We reserve the right to modify, suspend, or discontinue the Site or any part of it at any time without notice. We will not be liable to you for any modification, suspension, or discontinuance. We cannot guarantee the Site will be available at all times and accept no liability for downtime, errors, or data loss resulting from service interruptions.
Governing Law
These Terms are governed by the laws of the State of California. You irrevocably consent to the exclusive jurisdiction of the courts of California for any dispute arising from these Terms or your use of the Site.
Dispute Resolution
Informal Resolution
Before initiating formal proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days of receiving notice.
Binding Arbitration
If informal resolution fails, any dispute will be resolved by binding arbitration under the Commercial Arbitration Rules of the American Arbitration Association (AAA), including where appropriate the AAA's Supplementary Procedures for Consumer Related Disputes. Arbitration will take place in Sacramento, California, or remotely by mutual agreement. The arbitrator's decision will be final and binding.
Restrictions
All disputes must be brought individually. There is no right to participate in any class action, class arbitration, or representative proceeding.
Exceptions
Either party may seek injunctive relief or other equitable remedies in a court of competent jurisdiction for disputes involving intellectual property rights, unauthorized access, or theft.
Disclaimer
The Site is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Site will be error-free, uninterrupted, or free of harmful components.
PiggyBucket is a financial education tool, not a financial institution. We make no representations or warranties about the suitability of any allowance structure, interest rate, or savings approach for your family's circumstances.
Limitations of Liability
To the fullest extent permitted by law, Emotive Engineering and its officers, employees, and agents will not be liable to you for any indirect, consequential, incidental, special, or punitive damages arising from your use of the Site. Our total liability to you for any claim will not exceed the greater of the amount you paid us in the twelve months preceding the claim or $10.
Indemnification
You agree to defend, indemnify, and hold harmless Emotive Engineering and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Site, your breach of these Terms, or your violation of any third-party rights.
User Data
We maintain your data in accordance with our Privacy Policy. While we perform regular backups, you are responsible for maintaining your own records of any data you consider critical. We are not liable for loss or corruption of data resulting from service interruptions or errors.
Electronic Communications
By using the Site and providing your email address, you consent to receive electronic communications from us. You agree that all agreements, notices, and disclosures we provide electronically satisfy any requirement that such communications be in writing.
Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Emotive Engineering regarding the Site. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision does not constitute a waiver of that right. We may assign our rights and obligations at any time.
